Terms of Use

1. Binding acceptance

By visiting the site, joining the waitlist, creating an account or installation, tapping agree, continuing past an age gate, or otherwise using the Services, you represent that you have read, understood, and agree to these Terms, the Disclaimer, the Privacy Policy, and the Refund Policy. If you use the Services on behalf of an entity, you represent that you have authority to bind that entity, and “you” includes that entity.

We may revise these Terms at any time by posting an updated version. The “Effective” date will change. Continued use after a posting constitutes acceptance. If you do not agree, you must stop using the Services and delete the app and local data.

2. Eligibility and age

The Services are for adults only. You must be at least 18 years old. You may not use the Services if you are a minor in your jurisdiction, even if 18 is lower than the age of majority where you live.

Every AI personality must be a fictional adult at least 21 years old. You may not create, describe, request, or continue any personality, image, voice, or scene that is a child, teen, age-ambiguous person, or anyone who reasonably appears under 21.

You represent and warrant that all age information you provide is true. We may suspend or destroy access if we believe this warranty is false. We do not knowingly provide the Services to children.

3. Private alpha; no promise of access

The public website is a waitlist for a private alpha. Joining the waitlist is not a purchase, not a reservation of capacity, and not a contract to give you the app, a feature, a model, or a launch date. We may invite, delay, refuse, or revoke access for any reason or no reason, including silently.

Alpha and other pre-release software is provided for evaluation only. It may be unstable, incomplete, wipe data, change without notice, or be withdrawn. You use pre-release software at your sole risk.

4. License and ownership

We grant you a limited, revocable, non-exclusive, non-transferable, personal license to use the Services solely for lawful, adult, fictional conversation as described in these Terms. We and our licensors retain all right, title, and interest in GoBantr, including software, models routing, branding, and site content.

You keep whatever rights you already have in prompts and local notes you create. You grant us a worldwide, royalty-free license to process that material as needed to operate the Services, including transmitting it to model providers to generate a reply. That license lasts as long as needed to provide the feature and to comply with law.

5. Fictional use only; no real people

Personalities are fictional. You will not use the Services to clone, impersonate, sexually depict, defame, stalk, harass, or commercially exploit a real person, including an ex-partner, celebrity, coworker, or anyone else, with or without their name.

You will not present AI output as a statement from a real human, professional, or institution. You will not use the Services to commit fraud, social engineering, or identity deception.

6. Strictly prohibited uses

You may not, and you may not attempt to, use the Services to create, store, request, or transmit any of the following. This list is illustrative and not exhaustive. We may treat related or evasive wording the same way.

• Any sexual or pornographic content involving anyone 17 or under, or who is age-ambiguous, “teen,” “young-looking,” or described as a child.
• Incest, sexual violence, non-consent, coercion, exploitation, trafficking, or sexual content involving animals.
• Content that assists in crimes, violent harm, weapons, or the abuse of another person.
• Attempts to bypass safety systems, jailbreak models for prohibited content, or reverse engineer the Services.
• Scraping, bulk account creation, resale of access, or use of the Services to train competing models except as permitted by law.
• Uploading malware, interfering with servers, or probing the Services except through a coordinated disclosure we invite.

7. Adult content is opt-in, not a right

Consensual fictional adult sexual roleplay may be available only if you explicitly enable it and only within the prohibited-use limits above. We may refuse, filter, or disable adult features at any time, including to satisfy providers, payment networks, or law. You are responsible for complying with the laws of the place you are in.

8. AI output is untrusted

Replies are generated by machine-learning systems. They can be false, biased, contradictory, offensive, repetitive, or unsafe. They are not facts, not advice, and not a record of a real relationship. You must not rely on them for medical, psychiatric, legal, financial, or emergency decisions.

We do not warrant that any personality will remain consistent, available, or aligned with your expectations. Editing a personality, changing models, or rebuilding summaries can change tone. Lost local data is your problem unless a separate written paid support contract says otherwise, which this alpha does not.

9. Local data and transmission

Version one is local-first. Conversations and personalities are intended to live on your device. Generating a reply still requires sending assembled context to our backend and to third-party model providers. Those parties have their own terms. We do not control their logs, training policies, or downtime.

You are responsible for backups, device security, Face ID, and who can unlock your phone. Uninstalling the app can destroy local data. We have no obligation to restore it.

10. Fees, credits, and taxes

The waitlist costs nothing. If we later sell credits, subscriptions, or other paid features, prices, taxes, and billing terms will be shown before you pay. Digital inventory can be consumed immediately. See the Refund Policy.

11. Suspension and termination

We may suspend, limit, or terminate access immediately if we believe you violated these Terms, created legal or reputational risk, or abused the Services. We may also discontinue the Services entirely. On termination, the license ends. Sections that by nature should survive (including disclaimers, liability limits, indemnity, and dispute terms) survive.

12. Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOBANTR DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, ACCURATE OUTPUT, OR THAT THE SERVICES WILL MEET YOUR NEEDS.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOBANTR AND ITS OPERATORS, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, GOODWILL, OR DEVICE VALUE, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $0 IF YOU PAID NOTHING. THESE LIMITS ARE A FOUNDATION OF THE BARGAIN. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITS; IN THOSE PLACES OUR LIABILITY IS LIMITED TO THE MINIMUM THE LAW ALLOWS.

14. Indemnity

You will defend, indemnify, and hold harmless GoBantr and its operators from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your content, your personalities, your violation of these Terms or law, your impersonation of others, or your misuse of AI output. We may assume exclusive defense at your expense.

15. Disputes

These Terms are governed by the laws of the United States and the State of the operator’s principal place of business, excluding conflict-of-law rules. Except where prohibited, you and we will resolve disputes only in individual arbitration under the AAA Consumer Rules. You waive any right to a class action, collective action, or representative action. You may opt out of arbitration within 30 days of first accepting these Terms by writing to the legal email below with your name, the email used on the waitlist, and a clear statement that you opt out of arbitration.

Nothing in this section limits either party’s right to seek injunctive relief for unauthorized use of intellectual property or for prohibited content.

16. General

If a provision is unenforceable, the rest remains in force. These Terms are the entire agreement for the Services and supersede prior discussions. You may not assign the Terms without our consent. We may assign them. Failure to enforce a provision is not a waiver. Headings are for convenience only. These Terms are a contract, not legal advice to you.
